Welcome to Amphyxia. By using our website or placing an order, you agree to the following Terms & Conditions.
1. Made-to-Order Products
All Amphyxia products are made individually per order. Because each item is produced specifically for you:
- Production may begin shortly after payment
- Cancellations are generally not possible
- Returns and exchanges are limited to defective or lost items
- Minor variations in color, print placement, and sizing may occur
- The EU 14-day right of withdrawal does not apply to custom-made, made-to-order products
2. Order Processing
- Orders are processed once payment is confirmed
- Production may begin immediately after purchase
- We reserve the right to cancel orders in cases of production issues, fraud concerns, or fulfillment limitations
3. Product Information
Because each item is produced individually upon order:
- Colors, print placement, and measurements may vary slightly
- These variations are normal and not considered defects
4. Order Cancellations
Because items are produced to order, cancellations cannot be guaranteed once an order is placed.
In rare cases, and solely at our discretion, a cancellation may be possible if production has not yet started.
5. Shipping & Delivery
- Shipping times depend on your location and production schedule
- Delivery estimates are not guaranteed
- We are not responsible for carrier delays, customs, or external factors
- If a package is confirmed lost by the carrier, we will provide a replacement or refund
- Shipping addresses cannot be changed once an order has shipped
6. Returns & Refunds
We accept returns or issue refunds only for:
- Damaged items
- Production defects
- Items lost in transit (confirmed by the carrier)
You must contact us within 30 days and include your order number and clear photos of the issue.
Not eligible for return or refund:
- Incorrect size ordered
- Buyer’s remorse or change of mind
- Customer mistakes during checkout
- Items that have been worn, washed, or used
- Damage caused by improper care or self-inflicted damage
- Unauthorized returns sent without approval
7. Customer Responsibility
Customers are responsible for:
- Providing accurate order information
- Entering the correct shipping address
- Choosing the correct size, variant, and product
We are not responsible for issues caused by incorrect customer information.
8. Limitation of Liability
We are not liable for:
- Shipping delays
- Carrier errors
- Indirect or consequential damages
We assist with replacements or refunds only in cases of confirmed damage or loss.
9. Intellectual Property
All designs, artwork, brand elements, images, and written content on this website belong to Amphyxia and may not be reproduced without permission.
10. Privacy & Data
Your personal data is processed according to our Privacy Policy.
We do not sell your information to third parties.
11. Right to Refuse Service
We may refuse or cancel orders suspected of fraud, abuse, or misuse.
12. Changes to Terms
We may update these Terms & Conditions at any time.
Changes take effect immediately upon posting.
13. Governing Law
These terms are governed by the laws of the Netherlands.
